ADA & FMLA Compliance Manual

In April 2015, NELI will host the nation's most comprehensive update of legal developments and practical advice on questions regarding ADA and FMLA compliance, a program unique to NELI. On Day One, special focuswill be given to the latest litigation/agency developments under the ADA Amendments Act concerning the definition of “disability,” including practical training tips for supervisors to avoid “regarding” an individual as disabled, the latest decisions involving the meaning of “qualified,” including “essential functions,” the importance of up-to-date job descriptions, and whether handling stress, rotating duties, lifting, and getting along with others are considered “essential.” We will also cover the latest developments on the changing definition of “reasonable,” including whether cost/benefit and “futility” are relevant, what sparks the accommodation interactive process, the latest cases on leave, schedule adjustments, reassignment, etc. Enforcing conduct rules will be addressed as well. Day One will also provide an update by our EEOC faculty on the Genetic Information Nondiscrimination Act (GINA), including the latest GINA cases and practical guidance for changes in workplace practices to comply with GINA.

Day Two commences with a session on requesting medical information under the ADA and emerging developments concerning voluntary wellness programs under GINA and the ADA. The FMLA Update will provide practical guidance in light of recent case law developments, including important coverage and eligibility issues, the significant impact of Windsor, leave to care for a family member, managing the medical certification process, and much more. Discussion of the most critical overlap issues between the ADA, FMLA and other leave laws will be covered as well.
