In this unique program, we bring together a distinguished panel, including EEOC representatives, to discuss every major aspect of evolving ADA and FMLA law. On Day One, special focus will be given to the dramatic changes brought about by the ADA Amendments Act and the EEOC's expected regulatory changes to the definition of "disability," including revisions to the definition of mitigating measures, whether certain conditions should always be considered disabilities, and effective ways to avoid getting caught in the expanded "regarded as" category. The issues of "qualified," "reasonable accommodation," "direct threat" and conduct rules will be extensively addressed as well.
Day Two is focused on the FMLA, and we'll provide practical guidance in light of the recent DOL regulations and case developments on managing intermittent leave abusers, how to best utilize DOL forms, appropriate and effective contact with the employee's health care provider, and more. Issues concerning the interaction between the ADA, FMLA and other leave laws will be covered as well.
All program participants will receive a copy of our ADA & FMLA Compliance Manual - both in a hard copy and on a searchable CD, which will be newly revised for this program.
Our California programs will feature distinctions between California and Federal law wherever appropriate.
