On June 17, 2009, in front of an overflowing meeting room, the Equal Employment Opportunity Commission approved proposed regulations implementing the ADA Amendments Act. These actions are extremely significant because they demonstrate enormous shifts in policy by the EEOC. It has also been suggested in light of the EEOC's stated position that the ADAAA is simply "restorative," that the Commission might immediately begin using the positions set forth in these proposed regulations in its litigation and enforcement.

Among many other things, the EEOC has suggested that it considers certain conditions to be automatic disabilities, that it will no longer consider it relevant to analyze activities an individual is able to perform, and that it intends to radically alter the analysis of when an individual is considered substantially limited in the major life activity of “working."

These proposed regulations will now be sent to the federal Office of Management and Budget (OMB) for review. After that, the EEOC will publish the proposed regulations for “notice and comment” by the public, before issuing final regulations.

We will discuss these dramatic EEOC proposals, including analyzing whether and how they might be changed during the next several months of review. We will also provide insights on whether the proposed regulations are consistent with the intent of the ADAAA negotiators and Congress, which will be particularly helpful for practitioners who intend to draft comments to the EEOC during the upcoming “notice and comment” period.

Panelists include:

David K. Fram, NELI's Director of ADA and EEO Services. Mr. Fram has trained tens of thousands of HR professionals and attorneys, and testified before Congress this year about the ADA and the proposed changes to the law.

Mike Peterson, Director of Labor and Employment Policy for the HR Policy Association. Mr. Peterson was a member of the primary group of negotiators on the ADAAA, representing all major employer associations.


HOW DO TELECONFERENCES WORK?

Teleconferences are cost-effective and convenient. You participate in the entire conference from your office using a regular telephone and your access code. Plus, for one fee you can have as many people participate as you can fit around a speakerphone, but only the registrant will receive CLE credit from NELI. This teleconference will run for approximately 60 minutes with a 30 minute Q&A following. During the speaker presentation portion of the conference, registrants are in a "listen-only" mode. After the presentation portion is concluded, the phones are "opened up" for an interactive Q&A session, with conference attendees queuing up to ask questions of the presenters. Questions can also be submitted via email at any time during the conference to be responded to during the Q&A session.

CLE AND OTHER CONTINUING EDUCATION CREDIT:

NELI's programs are routinely approved for credit in all jurisdictions with such requirements, provided that the jurisdiction approves teleconferences, and we have filed with all MCLE states and HRCI for accreditation for this program in it’s live format. (Kansas, Ohio and Indiana do not approve programs of this kind.) Registrants may be required to file for credit on their own behalf in some jurisdictions. We will provide all necessary forms and proof of attendance. Credit can be given to registered participants only. If you have questions regarding your state, please contact NELI. This program will provide between 1.0 and 1.8 hours of CLE credit, depending upon the jurisdiction.
