You must use E-verify if you are or want to become a Federal contractor or subcontractor, or if you're covered because of your receipt of ARRA funds. You should know about the compliance requirements of E-Verify if you represent a Federal contractor or subcontractor. For all other employers, you should use E-Verify because although participation in the program does not provide a "safe harbor" from worksite enforcement, using E-Verify does create a rebuttable presumption that your company has not knowingly hired an unauthorized alien.

    Through the Department of Homeland Security (DHS), the Obama Administration has made its’ commitment to E-Verify clear by announcing that it will fully implement the rule extending the E-Verify System to covered Federal contractors and subcontractors, including those who receive American Recovery and Re-investment Act funds, and that it will apply to federal solicitations and contract awards government-wide starting on September 8, 2009. The Senate also just approved Amendments to a House approved DHS appropriations bill to make E-Verify permanent and mandate that federal contractors use the system.

    We will discuss the final rule implementing Executive Order 12989, as amended by President George W. Bush on June 6, 2008, directing federal agencies to require that federal contractors agree to electronically verify the employment eligibility of their employees. The amended Executive Order reinforces the policy, first announced in 1996, that the federal government does business with companies that have a legal workforce. We will also cover the legislative history of the E-Verify program, formerly known as the Basic Pilot/Employment Eligibility Verification Program which was implemented in 1997 as a voluntary program and the status of the litigation surrounding its mandatory use by federal contractors, as well as of the legislation currently pending in Congress on this issue.

    HOW DO TELECONFERENCES WORK?

    Teleconferences are cost-effective and convenient. You participate in the entire conference from your office using a regular telephone and your access code. Plus, for one fee you can have as many people participate as you can fit around a speakerphone, but only the registrant will receive CLE credit from NELI. This teleconference will run for approximately 2 hours with the last 30 minutes devoted to Q&A. During the speaker presentation portion of the conference, registrants are in a "listen-only" mode. After the presentation portion is concluded, the phones are "opened up" for an interactive Q&A session, with conference attendees queuing up to ask questions of the presenters. Questions can also be submitted via email at any time during the conference to be responded to during the Q&A session.

    HOW WILL WE RECEIVE THE PROGRAM MATERIALS?

    CLE AND OTHER CONTINUING EDUCATION CREDIT:

    NELI's programs are routinely approved for credit in all jurisdictions with such requirements and we expect for this program to receive full accreditation provided that the jurisdiction approves teleconferences. (Kansas, Ohio and Indiana do not approve programs of this kind.) Registrants may be required to file for credit on their own behalf in some jurisdictions. We will provide all necessary forms and proof of attendance. We have also filed for credit through HRCI. CLE credit will be given to registered participants only.
